Title: Unauthorized use of our videos?
Post by: bib on January 25, 2011, 12:33:32 PM
Reallybigname brought this superb video to my attention:

http://www.youtube.com/watch?v=WfXjze544TE

The problem is that it uses some content from forums members, and I'm not sure the editor has asked for permission. At least he did not ask me. I have written a polite comment on his vid, let's see how he reacts.

There is content from buddhi (xlace), teamfresh, zongo, and more... (sorry if you see your work in the video and not your name here ;))

I'm not at all an expert in licences, but I find it not very correct to allow the usage of this vid under creative commosn when he did not get any prior permission from the original artists...

Thoughts?

first of all i like this video very much because it has everything, nice sound sync, zooms, and deforms
second it is a compilation of work of many others and should at least ask for permission

Don't mind the tune at all ... think I'll go download a bunch of Glasser.  Seriously though,  they could have at least credited the artists if not asked permission.  I don't think "All footage collected from YouTube and Vimeo under Creative Commons License" covers it.  I'm always careful to at least credit where things have come from, whether it's a background texture or a half second bit of sound.

But it's a great editing job, and they did add a bit of a glow effect.  It'd be way worse if it was a bad edit they were actually trying to sell for cash.  And I'm actually a little disappointed none of my stuff is in there >:(

Yeah, not giving credit was the scummiest...  (and not picking my vids too)   :-\

Really liking this Glasser album! Thanks for the heads-up, fractal appropriating editor guy...

The author contacted me on Vimeo to give me the link to his video. I wish he asked before making it but I like the editing too, it's nicely done. Actually I thought it was a common practice because I saw a couple of other 3d fractals compilation on Youtube. I didn't think about saving the links but I'm sure you can find those easily.

I see all the credits there now, on youtube and vimeo.  Well, that's cool at least.

We are so open , friendly and giving i think it is right to expect a bit of give-back!

I know that some of us make a living from this artistic endeavour and i would not want to see them harmed, however if amember publishes to an open .social network site without protecting their work or use of it i do not know what we can do as a forum.

Maybe draft up some sensible advice about protecting your work and put it in the board guidelines? What do you think?

@Jehovah: I think that's a good idea.  It's sort of a nebulous area that if you're not up to speed on can bite you in the butt.

It also begs the questions of whether we need to go through the trouble of watermarking everything we do. :(  We seem to try not to make it a secret who we are when we post, so how hard is it to ask?

Cool. I very much liked the brief flash of the pink Mandelbulb in this video. Back to the roots, kind of. Congratulations on your 1000th post by the way.

Vimeo has  a page where you choose what copyright you want to put on your work. Maybe we should go ask those guys what they know? :)

I always go for the CC 'Attribution-NonCommercial-NoDerivs' license. Same goes with my music projects when I choose to release free stuff. This way people really interested into remixing/using bits usually contact me first and ask the permission. I almost always agree, I like derivative non-commercial work but I also like to be asked for it 1st. For me this is only a matter of common courtesy.

I think the funniest thing really is that if he just emailed me, all i would ask for is a placed link in his video description, then I would happily provide him with higher quality copy of the work.

I will say one thing though - These guys have good taste in fractals.... O0

*EDIT* there are links placed in the first videos description now, maybe they read this thread...

I was "informed" by the artist that my video (from Vimeo) had been added to this movie.  Didn't know whether to take it as a compliment or feel a bit ripped off.  Definitely more ripped off since I was not asked permission first and the clip he used is set up as "not available for public download" on Vimeo.  So it was "lifted" with some 3rd party software.

I have music in just about all my clips and I actively search out the musician's permission first.

The line in music is getting blurry with all the remixing and sampling going on, its inevitable that it will work its way into video also.

Mmmmh, seems like I recognized my "Like in a dream" video here at 0:40...

Lesson learned: I recently created a Vimeo account to upload my best vids in high quality. I have now removed them. Youtube quality is good enough for art thieves...

Send a notice to youtube, as well as the thieves.

With this new push to stop piracy, it may work better than in the past

With this new push to stop piracy, it may work better than in the past

In that particular case this is more complex than it seems. I found the video because the person in question sent a link to me where I could find the video. We are talking about doing business together, at a larger scale. So for this time, I will forget it because of the potential collaboration.

But just to let everyone know that it is a common practice among VJ's to rip videos from Youtube without asking for any authorization...

... the clip he used is set up as "not available for public download" on Vimeo.  So it was "lifted" with some 3rd party software.

I would not consider the "lifting" as a violation because there is not alternative to see HD video without seeing just crap:

Except than with excellent ADSL connection watch streaming video (even more at full size ) is a pain, they freeze every few second so the only solution is download them and see them later when fully downloaded

i hope you don't consider that a violation ,the only alternative would be not see the video

Disable the download is not too effective...on internet whatever may be seen may be also downloaded may be (it is a just  bit a  more complex do from vimeo than from youtube )

Downloading a youtube video for offline viewing is, to my knowledge, not copyright violation.

Using scenes from a downloaded video in work you are presenting as your own most certainly is!

It happened to me too a while back. A friendly user on YouTube notified me about it. I contacted the user who copied my videos. He didn't answer so I flagged to videos and they got deleted. It was really strange, because my videos were copied with intro and outro included, thus crediting me, but then... what's the point in re-uploading videos?

I see this type of stuff all the time on Youtube. The situation is dire with fanart as well. If anyone has browsed my deviantart favorites, they will know that I'm kind of a junkie for nintendo fanart. I typed in "Princess Peach" on youtube, and there are tons of fan-art slideshows; mostly they just put "source: deviantart.com" in the description and assume that's enough to give proper credits, even though millions of users post their art there.

And anyone concerned about controlling content uploaded to the internet, don't bother. keep-tube.com is all you really need to download any video from literally any popular site that caches video content through a flash player. I use it all the time to D/L videos to my hard drive for personal viewing.

Forgive me if this is a tad inappropriate, but some user by the name of "starsisterone" uploaded a compilation video montage composed of fractal stills + female models with "This is a magical movie with beautiful girls!" as the description.
http://www.youtube.com/watch?v=iuJHYek-JVk
Since I doubt very seriously he has obtained the necessary rights or permissions to the model photos, fractal renders, and background music, I can assume he merely assembled the images downloaded from the internet using some video authoring suite (for which he likely didn't obtain a valid software license), and uploaded to youtube. It's mildly entertaining, but it amazes me that 90% of the web users don't understand the concept of copyright. Forgive me if I am derailing, but it showcases the mentality of those people who simply compile stuff together and believe the web is their oyster, and everything they find online are pearls for them to play with.

Just ran across a 2 hour compilation of HD 3d fractal videos, including many of my own: https://www.youtube.com/watch?v=xuecSLLXTYM .  The YouTube channel belongs to "Tha Pixeltripper".

Given that the compilation is two hours long, I suspect that there is a significant amount of content culled from the works of other FractalForum contributors.  You may want to do a quick scrub through to see if any of your work was included.  Many of the clips that include my own work run almost the full length of the original videos.

I am certain that I was never asked permission to be included in this compilation, nor was I credited in any way in the compilation.  I am submitting a copyright infringement notification to YouTube. http://www.youtube.com/yt/copyright/copyright-complaint.html (http://www.youtube.com/yt/copyright/copyright-complaint.html)

There are some of my works too, and I don't remember if I was asked for authorization. Anyway there are credits in the description, and that seems non-commercial. It would have been polite to ask but I'm not sure if a copyright infringement notification is really necessary. The only thing that worries me, if you look on the channel page, is to be associated with all these ponies :D

It almost makes me glad my videos are so bad nobody wants to steal them   :hurt:

Yes, a link to the original videos was considerate, but I would have preferred to have been asked first.  That said, I too wouldn't have much concern about this if:
  • the clips were shorter, rather than being a significant amount of the original content
  • the compilation was not also available for download and further sharing
  • [and this may be very shallow of me, but...] the compilation wasn't getting more views than my original videos

There is nothing to stop someone from downloading and publishing this compilation on some other revenue-generating medium.  Granted, that may be true for any video posted online, but by posting a downloadable link to the compilation, Tha Pixeltripper crossed a line to me.

Not to me. In general I believe "sharing is caring". Of course there should be some limits on this (personal passwords, bank logins, personal opinions, sex, private thoughts).

Things as art, science and eduction should be as free and open as possible.

Hello. It feels a bit strange that my first post in this forum would be in a discussion about copyright, but this specific 2 hour compilation video encouraged me to download Mandelbulber, Mandelbulb3d and some other modern fractal renderers myself, mostly because the rather mediocre overall video quality made the beautiful shapes a pain to watch and urge for better quality. For me, this compilation posed a nice "hub" to jump to the channels of quite a few artists without having to manually search youtube for random fractal videos first. But of course I understand the concerns about an unrelated 3rd party offering a download for content you guys created.

So I guess Truman Brown will be happy to see that the video was taken down by youtube just a few hours ago, and the page is now mentioning his copyright claim.

Hello and welcome!

Regarding your point, the person in question could just as easily have made a playlist rather than using people's stuff without asking.

In fact, he could have just asked!

I know that sounds crazy - asking for permission to use something that isn't yours - but it is usually all it takes.  Not doing so is rude and discourteous and invites whatever consequences follow.

But I'm glad it got you working with some of the new toys!!   O0

Nobody said it was *all* bad, but is still a naughty thing to do, using other people's work without permission.

For what it's worth, I've been dabbling in computer graphics for over 20 years and have been approached many times with requests to use or incorporate my work in various collections and publications.  I have almost always said yes, because they asked first

This is just a hobby that I'm not terribly great at.  However, good, bad, or otherwise, what I create is mine.  I have yet to make any significant revenue from my work, so the greatest assets I have, personally, are ownership and control of what I create.  Take that away from me and you've taken everything.

Many of us here are hobbyists and enthusiasts and we do it for love not money. But it is always galling to find some of your work or enthusiasm lining somebody else's pocket!  It is also equally galling to see some other receiving plaudits for your work.

It is always a delicate balance between promoting and plagiarism. Today's electronic media makes it easier to site sources, and makes it plain what influences are contributing to your individual thought experience. For most of us a simple please and or thankyou is all we ask!  :-*
