Title: blatant art theft !
Post by: cKleinhuis on August 06, 2015, 01:19:58 AM
it came to my ear and eyes through facebook and deviantart, and i think everyone should be aware of it

http://www.ipernity.com/doc/643659
http://mandelbulb3d.deviantart.com/journal/Blatant-Fractal-Art-Theft-551386184

this person is taking images and publishing them as their own, which is by no way acceptable, the question is how can we effectively shut this person down and get the account silenced ???

one way could be to privately contacting everyone who has commented on that, and making them to remove their comments and state that it is a thefted image
contacting the company might be another method, i think bib already did so

i send the company an email requestring to cancel the account.... everyone who is affected shall do the same that the company realizes that we do have a point here

I have found the simple solution is to only produce mediocre images, some of you guys make the mistake of producing really good stuff. :D

But seriously, it is a bit weird for someone to, not only steal, but then sincerely accept credit for someone else’s work. Where is their head at? I guess its part of the weirding of the computer age world.

unfortunately we can't "make" them do anything, at least not without a lot of cash, but it is amazing what people will do to avoid mosquitoes, everyone that has any concern, directly or in passing, should post disapproval about it in public forums and be sure to mention the web address and account name, then let the bots do their work.

I note that in the gallery when looking at a single picture it says (for example http://www.ipernity.com/doc/643659/37657184) "Photo taken on April  7, 2015", these are not "photos" so could only be "taken" in one way, and I think that is the very definition of "theft".

admittedly I don't know if this particular image is an original by Zelda Kurowski or not, I am only using it here as an example to illustrate the point, it does, however, state on the page "(c) All rights reserved", ipernity.com , as the publisher, should be concerned but I am not educated regarding the copyright laws of the country where this site originates, or the EULA for members of ipernity.com .

the bots search this page and others will also accumulate hits, being known as plagiarists and thieves is not a desirable thing, me thinks.

just my 2c worth for the hungry bots ;)

edit:the DA page that mentions this already shows up at the bottom of the first page when searching "Zelda Kurowski" :D

Just checking it and to my big surprise she even got some of mine :
http://www.ipernity.com/doc/643659/35683241
http://www.ipernity.com/doc/643659/35413711
http://www.ipernity.com/doc/643659/35413701
http://www.ipernity.com/doc/643659/35007913
http://www.ipernity.com/doc/643659/34903637   Some got new names, some she just use the old name as I gave them.

All are posted on this forum. It is definitely a place for her to roam the site.   I do have a website but there the size of the picture is only 1280.  So that is not good enough I suppose ;)

Here is a very familiar one from our forum : http://www.ipernity.com/doc/643659/35284947  and I've seen plenty others that are definitely stolen.
I checked it out and I can report her but I wait until we all agree on how to act? Each on it's own or maybe all at the same time?
At the moment I'm very busy for we are moving to an apartment elsewhere and there is still so much to do :hmh:

Point will be that she will probably just assume another name and will continue in her same manner.  (?)  But we got to do something, right?

Greetings
Caleidoscope

Nothing I've ever put on fractalforums is on there.  Not sure what that says about my art ;-)

I was shocked that I saw some of my stuff!

Nobody ever liked my art enough to steal it before   O0

I'll post in the comments and report it to the site as plagiarism.  :police: :siren: :police:

EDIT - Wait...  that's not on deviant art!

Reporting it isn't possible and not sure we can do much except report it to their web hosting company.  Just gotta figure out who that is...

Here's what I posted in a report to their moderators  (I could not find out how to post a comment on that site!  It may be my no-script settings blocking it) and all are welcome to use this as a template, just substitute the appropriate links and information for your own art:

Hi.  This image was created by me and posted on FractalForums.com at March 22, 2015, 11:27:51 AM according to the date stamp showing here: http://www.fractalforums.com/index.php?action=gallery;sa=view;id=17220

MANY of this person's images are in our Gallery on that site, but I can only legally report my own and instruct you to remove it plus inform the member to stop stealing from our site!

This message can be considered sent as part of the DMCA laws regulating internet piracy.  A full and proper DMCA Notice requires I make a legal threat, but I am trying to keep this friendly.

I appreciate your attention to this matter.

Thank you.

LOL  me too, not even my family has any interest in my fractals what so ever, beside sometimes they will watch them just to be polite  LOL  Not that I care  :P
So whatever we decide to do I already had a good laugh today!

And Socratease thanks for the template.  I will follow your example!

Hehheh...

I originally said privacy when I meant piracy!

Once again, the posting before having coffee problem strikes!

I updated the template I posted here, but too late for the one I sent   :embarrass:

Yeah, the key to reporting this sort of thing is to identify yourself as creator and link to where it was posted prior to the pirated post - and to mention the Digital Millennium Copyright Act  (DMCA).

No problem - I hope others use it or something similar.

This was months ago, but our rights still stand.

And don't worry - I had to start mapping images of the woman I love to orbit traps before she began appreciating fractals...

@simon , hmmmm, same thoughts here.  And then again , I was going to suggest getting Zelda to judge next years art competition.

@ caliedoscope. So it is not only me that fails to inspire the family with fractals. My family is polite too.

@ Sockratease. So it is not only me that occasionally posts before coffee, and suffers the consequence. I personally have a talent for typo's.

Man!,  oh man,  to think of all the poor people who wasted their time praising "her" work, that is a secondary crime to be added to the stealing, I think the ipernity should redirect all favourable critiques to the creators of the original art work. LOL :)

that receiving of the comments is what struggles me most as well, because she is really taking the compliments as for her own work, seems to be a little closed foruim if no one mentioned seeing the images elsewhere

:D  Thank you Socratease you give me hope that one day they will see the charm of them, I'm over 60 so I hope they wont wait too long ;)
To be honest they do like some fractals from others on the forum and they ask me why I can't make beautiful fractals like that  :) Well it keeps me humble as you can understand and sometimes I just  :groupbutts:   and have a nice cool    especially when it is hot like today!

OT.  I just made a ticket as well, in Dutch so I'm curious if I will get the same message back from them as you do in English.

@Mclarekin  about asking her to judge might be a good idea for she doesn't have to search for them she can just take them one at the time :)  And I'm sorry but I'm glad I'm not the only one who can't inspire the family members, not even my close friends with fractals.   :drink:

Well after I send them the message about theft and closing down her account etc.  I tried to respond under our pictures on her site but that didn't work.
So I made my own account just for the time being and I send all of her admirers a message that they are spilling their time and compliments to an thief. And I've asked them to let everybody know so she can't continue with this shit.

As a bonus I put one of my own pictures on  'my page'  of course one she has stolen with a nice comment under it for anyone to see.
Maybe they will ban me, not that I care but in the meantime it is open and out.  Let's have some fun?

This is the page and once you can log in you can send messages to everyone.  I'm not planning to stay a member it's not my type of forum, just for now ;)

And now it is time for that ice cold beer I am longing for after a hot day packing everything in and running around for we will be moving this weekend :(
Nothing but stuff, stuff, stuff,  My God so much stuff  where does it all come from ?  :hmh:

I discovered two of my works there, so I posted a notice on facebook and in a group on there, so the word is getting around, we all need to report her. The terms and conditions on ipernity says, only authors original works allowed. She had the cheek to explain how she wanted a drab atmosphere on one piece, like she created it.
I have sent a ticket reporting this person, as have many other people, so hopefully she may get thrown out.
Well done Caleidoscope, that's a great idea. I noticed her friend T.a.o.n. read your post, that will be interesting.
Upset the fractal community, you get piles of shit in return!
I await their decision with anticipation :)
I am always up for a beer or two     Oh sod it, have three

I actually did it a little differently.

Since I couldn't post in their comment section I sent my message directly to our thief and informed her that I reported her posts as illegal and requested of her directly that she remove all stolen content from our site, and any other sites she stole from, promptly!  :hit:

I'll post if I get any reply either from the staff there or from the criminal.

I was a little pissed off to find 10 of my Artworks on the thieving, plagiarist, Zelda Kurowski's Ipernity photostream.

How she has the audacity to claim the artworks as her own is beyond me!

I signed up to Ipernity, and posted the 10 stolen works on my Ipernity photostream, adding the following description...

"This is one of my original artworks. It was created using Mandlebuld3D software.

This art work was stolen from the Fractal Forum website by ipernity user Zelda Kurowski, and published on Impernity. An act of theft!

Not only did she steal my artwork, she also had the audacity to pass it off as her own work. An act of plagiarism!

She then lied to people who commented on the art work. An act of deception!

If you feel that theft, plagiarism and deception are unacceptable, then please let Zelda know!
www.ipernity.com/doc/643659

 Many thanks."

I then added all Zelda Kurowski's Ipernity contacts to my Ipernity contacts, hopefully they're looking!!!!

Thought I might send Zelda Kurowski an ipernity email.......

"It has come my attention, and that of the global fractal art community, that you have stolen fractal artworks, and published them on the Ipernity website, without permission or accreditation of the talented artists. An act of theft.

You then have the audacity to pass these artworks off as your own work. An act of plagiarism.

You then lie to the ipernity community commenting about the artworks. An act of deception.

The fractal art community does not take kindly to theft, plagiarism and deception.

You have 10 of my copyrighted artworks published on your stream. I will be taking legal action against the infringement of copyright.

Let the shit rain down!!"

I would encourage the fractal community, also send Zelda a special message!

I hope everybody is both messaging our thief as well as reporting their images as illegal posts in violation of both copyright laws as well as the Digital Millennium Copyright Act!!

I have, so far, received no replies to either my message to the crook or my reporting of an illegal post.

I didn't expect the thief to reply - obviously they don't care what we have to say or what we (or anybody else) thinks!  But I am surprised the site itself has not at least replied.

I haven't posted my image and added those who commented on it, but it's a great idea and one I shall pursue if no action is taken by the site by tomorrow morning   :police: :siren: :police:

I know there is a time and a place for everything, and this certainly is the time and place for it, but please keep the profanity to a minimum.

I have no problem with it, but there may be children on this site and we like to set a good example of how adults deal with adversity.  Using profanity is exactly what I wanted to do, but on here on Fractal Forums we try to show as much restraint as possible since we encourage teachers to send their younger minds here and many teachers could see that and choose not to recommend us.  Nobody's posts will be edited or anything, but if something isn't said I can see it getting out of hand.  Thanks for understanding   O0

A good point, well made, Sir. You have my apologies, I was a little angry!

Absolutely no worries!

As I said, a time and place for everything.

If ever profanity was called for - this is that time and place.

I just had to say something since I am a moderator here and don't want to be seen as encouraging such things.  I was not singling you out by quoting you  (others used profanity too, and that was directed at everyone)  (even those who may just be thinking about using it but have not yet done so!) - I quoted you to comment on the rest of your post   O0

A well thought out argument and I used much of it when I posted my own pirated image on ipernity just now.

You could say I plagiarized your post and I should be forced to remove it   :dink:

user named ".t.a.o.n." from http://www.ipernity.com states very clearly on his home page ...
"please don't use any images from this stream on websites, blogs or other media without my explicit permission. © all rights reserved thank you !"
but the urls and feel of the site seem a bit off, compare the urls from any other site to the ones found in/on ipernity.com

I think it's a trap!

The replies I got on the site are all kind an even angry at Zelda and stating that they have removed her etc.  The only one that is defending her and even in a slightly angry manner towards me is one called Freedom:
http://www.ipernity.com/mail/view/inbox/9755668?t=87825&c=1&s=mail
It would not be a suprise if this is Zelda too.

To think that this site and all the members are Zelda?  Ik can hardly believe that, for that would be an enormous amount of work and time. To comment on
each other,  all the time making different pages etc... ?    In that case he would be a very sick individual that needs to be hospitalized to get psychic help and lots of medicine I presume.  Well if he is indeed Ipernity himself  than he is getting a lot of new members and pictures from us ; )

Have a good day you all.
Caleidoscope.

Could everybody that has a site now on Ipernity put this here so we can all join together?

Somehow they posted my own stolen image on my own page and imply that I am crediting the thief!!

I made a comment on my own page that reads thus:

Quote
This site appears to endorse thievery!

No reply in over 24 hours to a DMCA Warning about user Zelda Kurowski STEALING my Art!!!

I see my Warning may need to evolve into an Official DMCA Notice complete with Legal Threats and backed by lawyers and evil ugly stuff - followed by fines for site management and hopefully ZK too!

24 hours left, impernia. You get 48 hours to reply and you wasted the first half.

Do NOT enrage the World Wide Fractal Art Community or we will ALL come down on this site with every legal tool at our disposal.

Soooo...

Do we have any Lawyers in the group?

We may need one!

Hi Socratease I've been searching for you but I can't find you on ipernity   :sad1: :'(

I just now uploaded the rest of the pictures she stole from me and put that in the comment as wel.
It was very strange for It just took a few seconds for I only had to paste the comment I prepared before but every picture I uploades that Freedom figure gave it a comment or a like allready like she was waiting.  Just maybe half an hour before I gave her again a message with the threat of legal action and that the cost for one picture a day is 20 euro.  Well can anybody down here calculate the amount she owes us?
There is been a lawsuit and I've read that this can be minimum amount judges will charge for infringements on copyright.  So that is a lot of beer  oeps, I'm sorry I wouldn't mention beer here anymore ;)

Have a good day!
